Terms of Service

Overview

These Terms govern your use of EverHue, including our website, app, photo scanning, restoration, colorization, purchases, and support. By using EverHue, you agree to these Terms. If you do not agree, do not use EverHue.

Who can use EverHue

  • You must be at least 13 years old to use EverHue, or older if your country or region requires a higher minimum age.
  • If you are under 18, you may use EverHue only with permission from a parent or legal guardian, and that parent or guardian is responsible for your use of EverHue.
  • If you use EverHue for someone else, you must have their permission and authority to do so.
  • You are responsible for keeping your device, account, purchases, and submitted photos under your control.

Your photos

Your photos remain yours. You keep any rights you have in the photos you submit and in the processed results we return to you. You are responsible for making sure you have the rights, permissions, and consent needed to upload, process, save, and share those photos.

License to process photos

When you submit a photo, you give EverHue and the service providers that help us operate EverHue a limited, non-exclusive, worldwide license to receive, host temporarily, transmit, modify, display, and process that photo only as needed to provide, secure, troubleshoot, and support the features you request. This license ends when it is no longer needed for those purposes, except where we must retain limited information for legal, security, billing, or abuse-prevention reasons.

AI and photo results

  • Restoration, enhancement, and colorization results are generated estimates and may be incomplete, inaccurate, or historically wrong.
  • EverHue is not an archival, forensic, medical, legal, identity-verification, or emergency service.
  • You are responsible for reviewing results before relying on them, publishing them, or using them in sensitive contexts.

Purchases and credits

Prices, credit packs, and included features may change for future purchases. Credits are not cash, are not transferable, and may only be used inside EverHue. Credits do not expire unless we clearly say otherwise before purchase or a payment platform rule requires a different result. Refunds, chargebacks, taxes, and payment issues are handled by the relevant app store or payment provider, except where applicable law requires something else.

Acceptable use

  • Do not upload photos or content that you do not have the right to use.
  • Do not use EverHue to violate privacy, publicity, intellectual property, consent, or other legal rights.
  • Do not upload, create, request, or share child sexual abuse material, sexual content involving minors, non-consensual intimate content, or content that exploits or endangers children.
  • Do not use EverHue to create impersonations, deepfakes, fake identity documents, scams, misleading content, or content intended to deceive, defraud, manipulate, or harm someone.
  • Do not use EverHue for harassment, stalking, bullying, threats, hateful or discriminatory content, incitement to violence, extremist content, or graphic violence.
  • Do not upload malware, instructions for wrongdoing, or content intended to abuse, disrupt, or bypass any service, device, account, payment system, or security measure.
  • Do not reverse engineer, scrape, overload, resell, interfere with, bypass limits on, or misuse EverHue or its systems.

Our service

We may improve, change, suspend, or discontinue parts of EverHue at any time. We may also add limits when needed for security, reliability, fraud prevention, legal compliance, or product operation. We will try to act reasonably, but we do not guarantee that EverHue will always be available, uninterrupted, secure, or error-free.

Third-party services

EverHue may depend on app stores, payment processors, hosting providers, analytics tools, support tools, and photo-processing providers. Their own terms and policies may apply. We are not responsible for third-party services outside our control.

EverHue rights

EverHue, including our app, website, software, designs, branding, text, and technology, belongs to us or our licensors. We give you a limited right to use EverHue for its intended purpose. You may not copy, modify, distribute, sell, or reverse engineer EverHue unless the law gives you that right.

Disclaimers

EverHue is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability. Nothing in these Terms limits rights or warranties that cannot legally be limited.

Liability limits

To the extent permitted by law, EverHue and its owners, team, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost photos, business interruption, or reputational harm. To the extent permitted by law, our total liability for any claim related to EverHue will not exceed $50.

Indemnity

You agree to defend, indemnify, and hold EverHue and its owners, team, affiliates, and service providers harmless from claims, losses, liabilities, damages, costs, and expenses arising from your photos, your use of EverHue, your violation of these Terms, or your violation of someone else's rights or the law.

Termination

You may stop using EverHue at any time. We may suspend or terminate access if we believe you violated these Terms, created legal or security risk, misused the service, or caused harm to EverHue, other users, or third parties.

Disputes

If a dispute comes up, please contact us first so we can try to resolve it informally. Unless applicable law requires otherwise, disputes will be handled in the courts with jurisdiction over EverHue's principal place of business, and the law of that place will apply without regard to conflict-of-law rules.

Changes

We may update these Terms from time to time. If we make important changes, we will update the date on this page and, when appropriate, provide additional notice. Continuing to use EverHue after changes take effect means you accept the updated Terms.
